The petitioner is in custody in connection with Sursand P.S. Case No.60 of 2019, registered for the offences punishable under Section 414 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case 174 litres liquor was recovered. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 09.03.2019.
Considering the facts that petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand)
Patna High Court CR. MISC. No.35147 of 2019(2) dt.28-05-2019 2/2 with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Sursand P.S. Case No.60 of 2019.
