JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-09-2021 Perused the letter no. 159/ Bhagapur dated 20.03.2021 written by the learned Additional Sessions Judge-X (I/c), Bhagalpur. This Court has been reported that after rejection of his first bail petition on 08.06.2021, the petitioner made false statement and fabricated false evidence before the learned Additional Sessions Judge-X (I/c), Bhagalpur that no application for regular or anticipatory bail petition had been filed before the Hon'ble High Court at Patna. The copy of the bail petition has been enclosed with the letter. Paragraph '2' of the bail petition reads as under:- "That, the petitioner had earlier filed an application for regular bail before your honour it was rejected vide order dated 08.06.2021. No application for regular/Anticipatory bail has been filed before Hon'ble High Court, Patna."

Patna High Court CR. MISC. No.42812 of 2021(3) dt.06-09-2021 2/2 The copy of the order dated 29.07.2021 passed by learned Additional Sessions Judge-X (I/c), Bhagalpur has also been made available to this Court.

It further appears that the learned court below has already issued a show cause notice to the petitioner and the learned Advocate through learned A.P.P. for the State.

In view of the fact that the learned court below has already proceeded to take appropriate action by issuing show cause notice to the petitioner and his Advocate, this Court is not proceeding with the matter at this stage.

This application is being disposed of expecting that the learned court below shall pass appropriate order after considering the show cause. In future while acting as In-charge Court the learned Presiding Officer is required to be very cautious in such matters where prayer for bail has been rejected very recently by the regular Presiding Officer of that court and there is any chance of being misled.

The application stands disposed of accordingly. Mr. Renuka Ratnakar, learned A.P.P. for the State is present.
