2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 318(4), 303(2) and 317(4) of the Bharatiya Nyaya Sanhita, 2023.

3. The case of the prosecution is that from the possession of this petitioner one mobile and four ATM were recovered. It is further alleged that for the purpose of helping the innocent people, the petitioner learnt their PIN number of their ATM and withdrawn the amount from their account by using the said ATM card.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that all

It is further submitted that nothing incriminating articles have been recovered from his possession. Moreover, the petitioner is languishing in judicial custody since 27.02.2025.

5. Learned APP appearing for the State has opposed the prayer of regular bail stating that the petitioner has five criminal antecedent.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barauli P.S. Case No. 58 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Gopalganj.
