The petitioner seeks bail in Special Case No. 3567/ 2020, arising out of Rajeev Nagar P.S. case No. 152/2020, registered u/s 30(a), 37(b) (c) of the Bihar Prohibition & Excise Act.

The learned counsel for the petitioner submits that police after having received secret information about unloading of huge quantity of liquor in the Khatal of Brij Narayan Yadav raided the place. Three persons, namely, Aditya Raj, Uday Shankar and Akash Kumar, the petitioner, were apprehended. 250 liters of liquor of different brands was recovered. It is submitted that Aditya Raj and Uday Shankar have already been granted bail vide orders passed in Cr. Misc. No. 24014 of 2020 and Cr. Misc. No. 22309 of 2020 and the case of petitioner

Patna High Court CR. MISC. No.34379 of 2020(2) dt.15-01-2021 2/2 stands on same footing.

Taking into consideration the facts that similarly situated two other accused have already been granted bail and the petitioner is in custody since 22.05.2020, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna in connection with Special Case No. 3567/ 2020, arising out of Rajeev Nagar P.S. case No. 152/2020.
