SONI SHRIVASTAVA ORAL ORDER 06-05-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the opposite party no. 2. The parties to the proceedings also present in the Court today.
2. By the last order dated 17.04.2025 which was taken up in Chambers, the petitioner and the opposite party no. 2 had agreed to go together to the house of the petitioner and the matter was said to be listed after 15 days which is today.
3. Both the parties to the proceedings have stated before this Court that they are staying together and no major difference has cropped up between the parties. It is expected that the parties to the proceedings would continue a peaceful conjugal life and the petitioner would always keep his wife with due dignity and honour.
4. In such view of the matter, let the above named
Patna High Court CR. MISC. No.37020 of 2024(7) dt.06-05-2025 2/2 petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 1946 (C) of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C./482(2) of the B.N.S.S., and subject to the further condition that the petitioner shall cooperate in the investigation/trial.
5. However, if the opposite party no. 2 at any stage faces some serious threat and a substantive evidence is brought before the learned court below with regard to the same, she would have the liberty to file an application for cancellation of bail and it also goes without saying that if the parties are staying together peacefully as husband and wife, the wife would also take efforts to withdraw the criminal case which is pending against the husband.
