02. In the present case, the petitioners are apprehending their arrest in connection with Gaurichak P.S. Case No. 34 of 2024 registered for the alleged offence under Sections 304(B)/34 of the Indian Penal Code.

As per prosecution case, marriage of the daughter of the informant was solemnized with co-accused Sachin Kumar and petitioners are brother, father and mother of the co-accused Sachin Kumar and allegation against them is that of torturing and assaulting the daughter of the informant on account of

Patna High Court CR. MISC. No.31913 of 2025(2) dt.19-05-2025 2/3 dowry demand. When the demand was not met, the daughter of the informant was strangulated to death.

04. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. Petitioner No. 1 is brother-in-law, petitioner no. 2 is fatherin-law and petitioner no. 3 is mother-in-law of the deceased, respectively. There is no specific allegation against the petitioners who have been living separately from the husband of the deceased as a partition took place before Gram Kachahari and a partition deed was prepared on 06.10.2023. Thus, the petitioners live in a separate house. For this reason, no offence under Section 304(B) IPC is made out against the petitioners who are poor labourers and daily wage earner. The petitioners are having clean antecedent.

05. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the fact that the petitioners are in-laws and allegations are general and omnibus and also considering the possibility of false accusation, let the petitioners above named, in the event of their arrest or surrender before the court concerned within a period of

No.31913 of 2025(2) dt.19-05-2025 3/3 eight weeks from today, be released on bail, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Patna City/court concerned in connection with Gourichak P.S. Case No. 34 of 2024, subject to the condition laid down under Section 482(2) of BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial court.
