The petitioner is languishing in custody since 25.04.2014 in a case registered for the offences punishable under Sections 376, 379, 406, 506/34 of the Indian Penal Code and 6/4 of the Protection of Children from Sexual Offences Act. It is alleged that the petitioner being the neighbour of the informant used to take 12 years daughter of the informant to School but in the meantime he sexually exploited the daughter of the informant and took away jewellery from the house of the informant worth Rs. 2,00,000/-.

It is submitted by learned counsel for the petitioner that though the accusation has been supported by the victim in 164 and 161 Cr. P.C.

Patna High Court Cr.Misc. No.40521 of 2014 (3) dt.19-01-2015 2 / 2 statement but the medical report does not suggest any evidence of rape. The victim has been found to be 16-17 years. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the medical report and the fact that investigation has already concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1, Patna, in connection with Special Case No. 16/2014, arising out of Ram Krishna Nagar P.S. Case No. 65 of 2014.

Learned court below will be liberty to cancel the bail bond of the petitioner if the petitioner defaults for two consecutive occasions. U.K./- (Dinesh Kumar Singh, J) U T
