Considering the disputed nature of contest which survives for consideration where, while it is the stand of the State as well as the private opposite party that encroachment has been removed, Mr. Devendra Prasad Singh, learned counsel appearing for the petitioner though contests such submission on oral instructions but has not produced any document or paper to support such contest, the matter deserves to be brought to a close and is accordingly disposed of.
