Petitioner, already in custody, seeks bail in connection with Dhanarua P.S. Case No.254 of 2016 registered under Sections 341, 342, 323, 325, 307, 379, 504 and 506/34 of the Indian Penal Code.
Allegation in brief is that one Bittu Kumar intercepted the informant while going to an orchard and assaulted with danda on his chest causing fracture in his ribs and also opened fire but missed the target and it is alleged that one person was also assisting him.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR, though he is well acquainted with the informant as they are co-villagers and the petitioner has

No.50024 of 2016(7) dt.26-07-2018 2/2 been later on implicated only being brother of Bittu Kumar, however, in the entire FIR, there is no accusation against the petitioner of causing assault and the petitioner has been in custody in this case since 26.05.2016 and only in recent past, the case has been committed to the court of sessions. Having considered the aforesaid facts and circumstances and the fact that there is no specific accusation against the petitioner, petitioner Rohit Kumar @ Gabbar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Mashauri, Patna in connection with Dhanarua P.S.
