JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-12-2020 Heard Mr. Sada Nand Roy, learned counsel for the petitioners and the learned APP for the State. The petitioners seek bail in connection with Excise Case No. 345 of 2020 arising out of Durgawati P.S. Case No. 137 of 2020, dated 27.05.2020, instituted for the offences under Sections 414 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It appears from the accusation that 281.310 litres of liquor was recovered from a vehicle which was being

Learned counsel for the petitioners has submitted that the recovery has wrongly been saddled upon them as they have clean antecedents.

The petitioners are stated to be in custody since 28.05.2020.

Regard being had to the period of custody of the petitioners, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 5th Addl. Sessions JudgeCum-Special Judge, Excise, Kaimur at Bhabhua in connection with Excise Case No. 345 of 2020 arising out of Durgawati P.S. Case No. 137 of 2020.
