The petitioner apprehends his arrest in connection with Jagdishpur P.S. Case No. 486 of 2021 registered under Sections 341, 323, 324, 307, 326, 498(A) and 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act and later on Section 304 B of the Indian Penal Code has been added. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on suspicion. Further submission is that in the fardbeyan of the deceased she stated that she got burn injury due to gas leakage while she was lonely making tea in the kitchen, thereafter, she was initially rushed to
Patna High Court CR. MISC. No.34095 of 2022(5) dt.09-01-2023 2/2 Rajendra Hospital and then to Apollo Burn Hospital, Patna and she also stated that none of the family members are responsible for the said incident. It is also submitted that petitioner has got no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Chief Judicial Magistrate, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 486 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
