The petitioner apprehends his arrest in a case in connection with Complaint Case No.C1/1129/16, registered for the offence punishable under Section 498A of the Indian Penal Code and sections 3⁄4 of the Dowry Prohibition Act. Vide order dated 05.07.2021, notice was issued to the O.P. No.2. Vide order dated 04.10.2021, Court has directed the Superintendent of Police, Sitamarhi to ensure that the O.P. No.2 is made aware of the pendency of the present case. Further, it was to ensure that the O.P. No.2 enters appearance in the present case, either by engaging any counsel or if she needs help, she will inform the Patna High Court Legal Services Committee for

Patna High Court CR. MISC. No.36620 of 2020(5) dt.23-11-2021 2/2 providing a learned counsel to represent her in the matter. Learned APP for the State submits that the S.H.O. has telephonically informed him that the O.P. No.2 is residing in Bombay and is not available in Sitamarhi and she also stated that after returning to Sitamarhi from Bombay, she will appear in the present case.

Having regard to the facts and circumstances of the case, the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Complaint Case No.C1/1129/16, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
