2. This application for anticipatory bail arises out of Shikarpur P.S. Case No. 261 of 2026 dated 03.03.2026, registered for the offences punishable under Sections 30(a) Bihar Prohibition and Excise Act.
3. As per the allegation, 27.735 litres of illicit liquor was recovered from the place owned by co-accused Baldev Prasad. It has been alleged that petitioners had kept illicit liquor at that place. It has further been alleged that local chowkidar identified the petitioners to be one of the persons,

4. Learned counsel for the petitioners has submitted that petitioners were not arrested at the spot. It has further been submitted that the alleged recoveries have been made from the land owned by co-accused Baldev Prasad. It has further been submitted that the local chowkidar, who is on an inimical terms has falsely named the petitioners. It has further been submitted that procedure prescribed under Sections 103 and 105 B.N.S.S. has not been followed. It has lastly been submitted that petitioner no.1 is accused in one another case of similar nature in which he is on bail while petitioner no.2 has got no criminal antecedent.
5. Learned counsel for the State has opposed the prayer of anticipatory bail of the petitioners.
6. Heard the parties and perused the record.
7. Considering the facts and circumstances and nature of material against the petitioners, let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Bettiah, West Champaran in connection with Shikarpur P.S. Case No.
