JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 19-02-2021 Heard Mr. Raj Kumar, learned counsel for the petitioner and Mr. Surendra Prasad Singh, learned Additional Public Prosecutor (APP) for the State.
2. The petitioner apprehends arrest in connection with Jhajha PS Case No.173 of 2018 dated 20.05.2018, instituted under Sections 323, 341, 324, 307, 504/34 of the Indian Penal Code.
3. The petitioner is the husband of the informant and the allegation is that he along with others had assaulted his father-in-law resulting in injury and specifically that he inflicted Tangi blow on the head.
4. After some arguments, learned counsel for the
Patna High Court CR. MISC. No.31690 of 2020(3) dt.19-02-2021 2/2 petitioner submitted that he be permitted to withdraw the application with liberty to the petitioner to surrender before the Court below and pray for bail.
5. Having regard to the aforesaid, as prayed for by learned counsel for the petitioner, the application stands disposed off as withdrawn with liberty aforesaid.
6. If the petitioner surrenders before the Court below within four weeks from today and prays for bail, the same shall be considered, on its own merits, in accordance with law, without being prejudiced by the present order. (Ahsanuddin Amanullah, J) J. Alam/- U T
