2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 420 of the Indian Penal Code.
3. As per the prosecution case, informant paid Rs. 25,000/- on 09.12.2020, Rs. 8,000/- on 12.01.2021, Rs. 92,000/- on 15.01.2021 to co-accused namely Amit Kumar Singh for the purpose of getting admission in the course of MBBS but did not get the admission and when informant asked him to return the alleged amount he refused to return the money.
4. It is submitted that from perusal of the F.I.R., it is apparent the entire alleged amount was paid to the co-accused
Patna High Court CR. MISC. No.33617 of 2023(2) dt.25-07-2023 2/2 Amit Kumar Singh and he has got no concerned with the alleged amount. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st Chapra in connection with Rasulpur P.S. case no 174 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
