The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 342, 323, 354, 379 & 427/504 of the Indian Penal Code. As per the prosecution case, all the accused persons named in the F.I.R. having arms are said to have reached at the place of occurrence and damaged the 'tatty' of the informant as fenced over her land. They also assaulted her husband and dragged the informant on the ground and taken away the
Patna High Court CR. MISC. No.31419 of 2020(4) dt.05-03-2021 2/2 ornament from the possession of the informant. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case due to dirty vllage politics. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. Both the parties are closed neighbours. Petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Katihar in connection with Barsoi (Suddani O.P.) P.S. Case No.84 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
