====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 15-03-2021 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, petitioners are seeking anticipatory bail in connection with Kawakol P.S. Case No. 92 of 2020 registered for offence punishable under sections 147, 148, 149, 341, 323, 324, 447, 448, 302, 307, 504 of the Indian Penal Code. As per allegation, 17 persons assembled and killed two persons by traditional weapons.
Learned counsel for the petitioners submits that there is no specific allegation made against these petitioners rather omnibus allegation has been made against them, but the fact is that 17 persons assembled and they had gone for ransacking and started assaulting the victim so it is very difficult to give the clear picture that who had done the aforesaid offence.
Patna High Court CR. MISC. No.32810 of 2020(3) dt.15-03-2021 2/2 It has also been submitted by learned counsel for the petitioners that other co-accused persons have been granted regular bail by one of the coordinate Bench of this Court in Cr. Misc. No. 28997 of 2020.
Looking to the entirety of the matter, this Court is not inclined to grant bail to the petitioners and accordingly their prayer for bail is rejected. However, if petitioners surrender before the court below and pray for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law.
