JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Chakai P. S. case no. 123/2018 registered under section 273 of the IPC and section 30(a) of the Bihar Prohibition and Excise Act.

Taking into consideration that alleged recovery of illicit liquor has been made from the house of the petitioner, I am not inclined to extend the privilege of anticipatory bail to the petitioner and accordingly, his petition stands dismissed. However, it is made clear that if the petitioner surrenders and seeks regular bail, regular bail application shall be considered without being prejudiced by this rejection order, particularly,
