Patna High Court Cr.Misc. No.33351 of 2014 (3) dt.23-01-2015 2 / 3 The petitioners are languishing in custody since 20.05.2014, 26.06.2014 and 20.05.2014 respectively in a case registered for the offences punishable under Sections 120(B), 385, 386 and 387 of the Indian Penal Code.
It is alleged that the petitioner Keshari Nandan Thakur @ Kartus through the Mobile Phone from the jail custody, demanded extortion of Rs.
30,00,000/-. Thereafter, quaantum of demand was reduced to Rs. 5,00,000/- and ultimately to Rs. 1,00,000/-. Ultimately, the informant paid Rs. 50,000/- which was subsequently handed over to the person authorized by the petitioner Keshari Nandan Thakur @ Kartus. The petitioners Harun Sah and Jinish Rai were apprehended with Rs. 30,000/-, two mobiles and other articles while escaping with received extortion amount.
It is submitted by learned counsel for the petitioners that recovery has been made after one month of registration of F.I.R.
The alleged recovered currency notes have not been put on T.I. Parade.
It is submitted by learned counsel for the petitioner Keshari Nandan Thakur that the alleged mobiles have been found registered in the name of some other persons than the petitioner Keshari

It is submitted by learned counsel for the petitioner Harun Sah that he was not identified in T. I. Parade.
Considering the aforesaid facts, let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Sitamarhi P.S. Case No. 388 of 2014.
Considering the fact that the petitioner Keshari Nandan Thakur has serious criminal antecedent, learned court below will be at liberty to cancel his bail bonds if he defaults for two consecutive occasions or gets substantially involved in some serious nature of offence.
