The petitioner is languishing in custody since 25.05.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. It is alleged that the husband of the informant went outside and thereafter he did not return. Suspicion was raised against the petitioner since four days prior to the occurrence the petitioner threatened the husband of the informant of bad consequences since he has signed in favour of one Rajesh Yadav with regard to cutting of Baniyan tree. Suspicion was also raised when one day prior to the occurrence the informant and her husband were cutting wheat crop one person came and asked the husband of the informant that one Basudeo Yadav is calling him.

Patna High Court Cr.Misc. No.40828 of 2014 (03) dt.22-01-2015 2/2 Binod Yadav, Umesh Yadav, Rabindra Yadav and Sunil Rawani were found following the husband of the informant when one day prior to the occurrence the husband of the informant was coming home.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and no direct evidence has been collected during entire investigation.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Tekari P.S. Case No. 111 of 2014. (Dinesh Kumar Singh, J) DKS/- U T
