This application, for grant of regular bail, arises out of Jay Nagar Police Station Case No. 129 of 2023, corresponding to G.R. No. 497 of 2020, registered for the offence punishable under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

It is alleged that 72 litres of foreign liquor has been recovered from the motorcycle of the petitioner. The petitioner is in custody since 30.03.2023 and he has no criminal antecedent.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case

Patna High Court CR. MISC. No.34466 of 2023(2) dt.24-05-2023 2/2 only on the basis of suspicion.

Considering the fact and circumstances of the case, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani, in connection with Jay Nagar Police Station Case No. 129 of 2023, corresponding to G.R. No. 497 of 2020.
