This application is filed for grant of regular bail in connection with G.R. No.327 of 2023 arising out of Jaynagar P.S. Case No. 86 of 2023 registered under Sections 272, 273, 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that there is recovery of 58.5 litres illicit liquor and also the petitioner is in custody since 27.02.2023. Petitioner has four criminal antecedents.
Learned A.P.P. has vehemently opposed the prayer for
Patna High Court CR. MISC. No.33793 of 2023(2) dt.23-05-2023 2/2 bail.
Considering the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge Excise Act, Madhubani, in connection with G.R. No.327 of 2023 arising out of Jaynagar P.S. Case No. 86 of 2023.
The petitioner will visit Jaynagar police station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
