JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1789 of 2016, disclosing offences under Section 498(A)/34 of the Indian Penal Code and Section 3/4 of the D.P. Act.
Allegation against the petitioner subjecting his wife with cruelty and harassment with respect to demand of dowry. Submission of learned counsel for the petitioner is that the opposite party no.2/complainant is residing with the petitioner.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with
Patna High Court CR. MISC. No.733 of 2019(3) dt.08-03-2019 2/2 direction to the petitioner to surrender before the court below within a period of six weeks from the date of receipt of the order and on that date he will also produce the opposite party no.2/complainant before the court below and the learned court below shall verify from the opposite party no.2 about her marital relationship with the petitioner and once the learned court below is satisfied with the same, he shall release the petitioner on bail to his own satisfaction, otherwise he is free to pass any order or orders as he deems fit and proper.
