JUSTICE JYOTI SARAN) Date : 06-05-2019 The grievance of the petitioner in this writ petition which is in the nature of Public Interest Litigation is that a complaint petition filed by the petitioner before the Incharge Officer, District Public Grievance Cell, Nalanda even though taken note of by the Circle Officer, Biharsharif, no action is being taken.
The pleading on record would conform the filing of the objection alleging encroachment by some people over a public land bearing Khata No. 355,Plot No. 2578 having an area of 22 decimals as well Khata No. 354, Plot No. 2579 having an area of 1 acre 54 decimal in Village Lalbagh, PS Biharsharif, District Nalanda.
In the circumstances noted, we allow the petitioner to file duly constituted application under Section 3 of the Bihar Public Land Encroachment Act, 1956, giving the name of the encroachers and the particulars of encroachment and since the matter has already referred to, before the Circle officer, Biharsharif, he would consider the application and dispose of the same in accordance with law, preferably within a period of six months of the filing of the complaint, with due opportunity of hearing to the complainant as well as the alleged encroachers.
