The petitioner has preferred this application for grant of regular bail in a case registered under sections 480, 467, 468, 471, 472, 387 and 34 of the Indian Penal Code. As per the prosecution case, it is stated by the informant that he was forcibly taken away by four unknown accused persons on two motorcycles in which he identified one Awadh Paswan. Subsequently he was transferred to a Bolero vehicle wherein kept of Awadh Paswan, namely, Khushboo was present. He further states that Awadh Paswan on the point of pistol forced him to acknowledge receipt of amount for
Patna High Court CR. MISC. No.35593 of 2022(3) dt.17-01-2023 2/3 execution of the deed in presence of other accused persons who must be Katibs as also Jitendra Ram who once again got the video and signature as also thumb impression on the stamp paper.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons. None of the alleged documents executed are in favour of this petitioner. Not being a beneficiary, there was no reason for him to participate in the occurrence. The petitioner is in custody since 5.4.2022 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR against the petitioner, the material that has transpired in course of investigation, the petitioner being in custody for 9 months since 5.4.2022, not having any criminal antecedent and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Bochahan P.S. Case no. 283 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st
