JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2018 The petitioner seeks bail in anticipation of her arrest in connection with Sitamarhi P.S. Case No. 451 of 2018, dated 01.05.2018, instituted for the offences under Section 414 of the Indian Penal Code and Sections 3, 4 and 5 of the Animal Cruelty Act.

The petitioner is the owner of the vehicle from where stolen goats were recovered.

Patna High Court Cr.Misc. No.72850 of 2018(2) dt.21-12-2018 2/2 submitted that the vehicle in question was given by the petitioner to somebody else for being plied on a commercial basis. The petitioner did not have any idea that it was used for carrying stolen animals.

Considering the facts aforestated as also taking into account the clean antecedents of the petitioner and her gender, she, in the event of her arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case No. 451 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
