The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code. As per the prosecution case, FIR is against unknown for the murder of informant's son.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Vivek Singh and Pushkar Singh to the effect that this petitioner was seen moving with co-accused persons near the place of

Patna High Court CR. MISC. No.42339 of 2021(3) dt.25-03-2022 2/2 occurrence at the relevant time. Similarly situated co-accused has Vivek Singh has already been allowed bail by a co-ordinate bench of this Court vide order dated 27.5.2020, passed in Cr.Misc.No.

3386/2020. Petitioner has claimed clean antecedent and he is in custody since 8.12.2020. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Piprakothi Police Station Case No. 162 of 2019.
