JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Mufassil (Aurangabad) P.S. Case No. 120 of 2020 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

According to the case of the prosecution, in a drive against trade of illicit liquor, Excise Officials recovered huge quantity of illicit liquor from various places. The petitioner has been implicated on the allegation that from a house constructed under Indira Awas Yojna, situated near the petitioner's house, 12.900 liters of illicit liquor was recovered. Petitioner is in custody since 29.07.2020. It has been stated in paragraph 3 of the application that the petitioner has no criminal antecedent. Considering the facts and circumstances,

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VII-cum-Special Judge (Excise), Aurangabad, in Mufassil (Aurangabad) P.S. Case No. 120 of 2020.
