2. In view of the explanation given by the petitioner, I am of the opinion that petitioner has sufficient explanation for delay and has got good case on merit.
3. Considering the same, the order impugned is quashed and set aside. Justice requires that the case be heard on merit. Matter is remitted to Bihar Land Tribunal to hear the case on merit. The writ petition is allowed with direction to petitioner to file petition before Bihar Land Tribunal within a period of eight weeks from today. In the event such petition is filed, the same shall be heard on merit after hearing all the parties and dispose of the case in accordance with law. (Prabhat Kumar Singh, J) vinita/- U
