The petitioner apprehends his arrest in Barun P.S. Case No.42 of 2019 registered under Sections 379, 411, 420, 34 of the Indian Penal Code and under Sections 4 and 40 of Bihar Miner Mineral Concession Rules and under Section 15 of Environmental Protection Act.

The informant alleged that one loaded truck with sand was intercepted and the driver of the truck disclosed that Vikash Kumar had hipped the sand from where he loaded the sand on his truck.

Learned counsel for the petitioner submits that petitioner did not hip any sand nor loaded the sand on the truck bearing No.UP50BT-8285. It is submitted that petitioner is

Patna High Court CR. MISC. No.30656 of 2019(2) dt.09-05-2019 2/2 accused in three criminal cases of the year 2014. Taking into consideration the fact that the name of the petitioner figured in the case on the basis of the disclosure made by the driver of the truck, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No.42 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
