ANJANA MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 12.6.2014 in Bakhari P.S.Case No.175 of 2014 of the offence under section 307/34 of the I.P.C. and 27 of the Arms Act.

It is submitted on behalf of the petitioner that he has been falsely implicated in the present case and it is only because the petitioner had association with one Jata Shankar Yadav who had some criminal antecedent, the petitioner, has been roped in the present case. It is further submitted that the main allegation of firing is against the co-accused, namely, Jata Shankar Yadav and not against this petitioner.

No.40642 of 2014 (4) dt.03-03-2015 2/2 Considering the aforesaid submissions and also the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai, Bakhari P.S. Case No.175/14.
