Learned counsel for the petitioners seeks permission to withdraw the petition with respect to petitioner No. 1 namely Murari Yadav @ Mukhi Yadav since he has been arrested.

Permission is accorded.

Accordingly, the petition with respect to petitioner No. 1 is dismissed as withdrawn.

The petitioner No. 2 is apprehending his arrest

Patna High Court CR. MISC. No.33482 of 2022(2) dt.24-11-2022 2/3 in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 427, 448, 504, 34 of the Indian Penal Code.

It is a case of assaulting due to which the informant and his father sustained injuries. The accused persons also damaged the motorcycle of the informant and took away Rs. 15,000/- and gold chain worth Rs. 50,000/-.

It is submitted by learned counsel for the petitioner No. 2 that in the background of some previous dispute, the present F.I.R has been registered. Moreover, good sense has prevailed between the parties and a compromise petition has been filed before learned Court below which has been annexed as Annexure-3 to the petition. A statement has been made in para 3 of the petition that petitioner No. 2 has no criminal antecedent. Case No. 333 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
