The petitioner is languishing in custody since 15.07.2014 in a case registered for the offences punishable under Sections 394, 302/34 of the Indian Penal Code and 27 of the Arms Act. It is alleged that the informant's son went to his liquor shop to bring the sale proceed and while returning this petitioner accompanied the son of the informant but on the way some unknown criminals caused injury to the son of the informant by fire arm as a result he succumbed to injury and robbed Rs. 1,50,000/- cash and ornaments but this petitioner has not received any injury.
It is submitted by learned counsel for the petitioner that there is no direct evidence against the petitioner and only suspicion has been raised against this petitioner. A statement has been made
Patna High Court Cr.Misc. No.40675 of 2014 (3) dt.20-01-2015 2 / 2 in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.
Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner at present in connection with Sarairanjan P.S. Case No. 79 of 2014 pending in the court of the learned J.M. Ist Class, Samastipur.
