The petitioner apprehends his arrest in Ram Krishna Nagar P.S. Case No.206 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The police recovered 34 liters of country made liquor from a field and alleged that the petitioner(Mithun Singh) and Sonu Singh were packing the liquor in pouches. The learned counsel for the petitioner submits that nobody has seen the petitioner packing the liquor. Nothing has been recovered from the possession of the petitioner. Taking into consideration the fact that nobody has seen the petitioner packing the liquor in an open field but the investigating officer on his own information named the

Case No.206 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
