The petitioner seeks bail in Nanpur P.S. Case No. 107 of 2021, registered for the offence punishable punishable under Sections 30, 30(a), 38(i)(ii) of the Bihar Prohibition and Excise Act, 2016.

892.800 litres of foreign liquor has been recovered from the orchard of co-accused Bijali Sah and petitioner and other co-accused persons are alleged to have fled away from the place of recovery.

It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from the orchard of co-accused Bijali Sah. Petitioner is in custody since 18.04.2021 having no criminal antecedent, as

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge Excise, Sitamarhi in connection with Nanpur P.S.
