JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-08-2021 Heard Mr. Umesh Chandra Verma, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Sugauli P. S. Case No. 387 of 2019, dated 13.09.2019, instituted for the offences under Sections 498A and 494 of the Indian Penal Code. It has been alleged against the petitioner that he has ill-treated Opposite Party No. 2 and has been demanding additional dowry.

It has been submitted on behalf of the

Patna High Court CR. MISC. No.31560 of 2020(9) dt.02-08-2021 2/3 petitioner that the accusation is absolutely false. There was matrimonial discord between the spouses only for the reason of the Opposite Party No. 2 asking the petitioner to move out to a separate house. Now, it has been submitted that the dispute between the spouses has been settled and Opposite Party No. 2 is residing with the petitioner as his wife. She has now no complaint whatsoever.

When this statement was made by the learned counsel for the petitioner, he was asked to file an affidavit regarding this fact.

A supplementary affidavit has been filed stating that Opposite Party No. 2 now is residing in the house of the petitioner.

It has further been submitted that in the event of the dispute having been resolved, the Opposite Party No. 2 shall be treated in accordance with the dignity to which she is entitled.

Regard being had to the afore-stated facts, the

Patna High Court CR. MISC. No.31560 of 2020(9) dt.02-08-2021 3/3 petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Sugauli P. S. Case No. 387 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
