The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 149, 341, 323, 353, 504 of the Indian Penal Code.

The prosecution case, in brief, is that when the informant alongwith other police personnel went to free two boys from the confinement of the accused persons, this petitioner alongwith other co-accused persons attacked the police party and made assault by lathi. Informant could somehow got released the boys from the confinement of accused persons.

Allegation of assault is general and omnibus. There is no injury report to substantiate the allegation of assault. Similarly situated co-accused Pintu Patel has already been granted anticipatory bail by a coordinate Bench of this Court,

Patna High Court CR. MISC. No.33750 of 2022(2) dt.15-11-2022 2/2 vide order dated 15.12.2021 passed in Cr.Misc. No. 18403 of 2021.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., West Champaran, Bettiah in connection with Sathi P.S. Case No. 12 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
