JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.
As per the allegation in complaint, the petitioner has taken Rs. 17,00,000/- for the execution of sale deed, to which later he denied.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that
Patna High Court CR. MISC. No.34310 of 2022(2) dt.24-11-2022 2/2 complainant sent a legal notice much after the laps of the period mentioned in the agreement. It is further submitted that this case comes within the purview of civil nature. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sub Divisional Civil Court, Dehri (Rohtas) in connection with Complaint. Case No. 193 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
