2. Petitioner seeks regular bail in connection with Motihari Muffasil P.S. Case No. 80 of 2024 in a case registered for the offence punishable under Sections 414, 420 and 467 of the Indian Penal Code and Sections 30(a), 32 and 41(1) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 158.625 litres foreign liquor was recovered from a motorcycle.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has falsely been implicated because she is the wife of the main accused. Nothing has been recovered from the conscious possession of the
Patna High Court CR. MISC. No.32923 of 2025(2) dt.18-07-2025 2/2 petitioner. Petitioner has got no concern with the alleged recovery. Petitioner is in custody since 24.03.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application of the petitioner and submits that petitioner has got two criminal antecedents of similar nature.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise-I, East Champaran at Motihari in connection with Motihari Muffasil P.S.
