This application for anticipatory bail arises out of Bihta P.S Case No. 596 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 307 and 379 of the Indian Penal Code.
Learned counsel, appearing on behalf of the petitioner, has submitted that, in similar circumstance, coaccused Sanjeev Kumar @ Sanjeev Yadav has been granted anticipatory bail by this Court by order dated 06.11.2018, passed in Cr. Misc No. 61120 of 2018.
I find substance in the said submission of the counsel for the petitioner. Accordingly, the application is allowed. Let the petitioner above named, in the event of his arrest/surrender
Patna High Court Cr.Misc. No.73026 of 2018(2) dt.18-12-2018 2/2 within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate,, 1st at Danapur, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
