26-10-2021 Heard learned counsel for the parties.

The petitioners seek bail in Lakhisarai (Kawaiya) P.S. Case No. 188 of 2021, registered for the offence under Section 30(a), 32(ii) of Bihar Prohibition and Excise Act. 2214 liters of foreign liquor has been recovered from a Hywa vehicle and these petitioners were arrested from a hotel. It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioners. Petitioners are neither owner nor driver of the alleged vehicle, from which, recovery has been effected. Petitioners have got clean antecedent and they are in custody since 25.03.2021. Investigation is complete.

Patna High Court CR. MISC. No.42236 of 2021(2) dt.26-10-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge II cum Special Judge Excise, Lakhisarai in connection with Lakhisarai (Kawaiya) P.S. Case No. 188 of 2021.
