2. The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case No. 387 of 2024 for the offence registered under Sections 329 (3), 329(4), 126(2), 115(2), 118(1), 110, 35 of the B.N.S.S., 2023.

3. As per the prosecution case, due to smoke arose from the crackers of the petitioner an altercation took place between the parties. Allegation against the petitioner is that he abused the informant and assaulted him by throwing bricks causing head injury to informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to previous land dispute. The alleged incident occurred

No.32887 of 2025(2) dt.20-05-2025 2/2 on 31.10.2024, however, the information was given to the police on 13.11.2024 and the FIR sent to the concerned learned Sub Divisional Judicial Magistrate, Rosera on 16.11.2024 without any plausible explanation of delay. The petitioner is a student of B.Sc. aged about 19 years having no criminal antecedent. He undertakes to cooperate in the investigation and trial of this case.

5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Bibhutipur P.S. Case No. 387 of 2024, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S. (Sunil Dutta Mishra, J) khushbu/- U T
