2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 376, 506 and 379 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner who is brother-in-law of the informant has committed rape for several times on her. It has also been stated that the petitioner has taken jewellery worth Rs.1,20,000/-, an OPPO company mobile worth Rs.20,000/- and a Sim card.

4. Learned counsel for the petitioner submits that there was land dispute between the parties. When the informant was brought for medical examination, she refused for the same. Learned counsel for the petitioner has also submitted that earlier the bail

Patna High Court CR. MISC. No.32687 of 2025(2) dt.22-05-2025 2/2 petition of the petitioner was considered by the learned Co-ordinate Bench vide order dated 28.02.2025. The learned Co-ordinate Bench has observed that "the petitioner would be at liberty to renew his prayer for bail after framing of charge". Learned counsel has filed a certified copy of the order sheet dated 04.04.2025 which goes to show that charge has been framed against the accused. The petitioner is having no criminal antecedent and is in judicial custody since 25.10.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sessions Trial No. 188 of 2025, arising out of Mahila (Begusarai) P.S. Case No. 12 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Begusarai.
