Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Jahanabad P.S. Case No. 145 of 2020 (Excise Case No. 320 of 2020) registered under Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The name of the petitioner has surfaced in the confessional statement of co-accused Raushan Kumar, owner of Bidhyavasni Sengar Store and some bottles of Indian made

Patna High Court CR. MISC. No.32102 of 2020(2) dt.20-02-2021 2/2 foreign liquor were recovered.

Submission is that petitioner has no criminal antecedent and his name has come in the confessional statement of co-accused.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/ arrest, within a period of four weeks from today, in connection with Jahanabad P.S. Case No. 145 of 2020 be released on bail on furnishing bail bonds of Rs 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J II, Jahanabad or the Successor Court subject to the condition as laid down under section 438(2) Criminal Procedure Code.
