By an order dated 28.08.2017 passed by the Superintendent of Police, Samastipur, the petitioner was suspended on the ground of pendency of criminal case against him being Bithan P.S. Case No. 142 of 2017 disclosing the offence punishable under Section 30(a)(d) of Bihar Prohibition and Excise Act, 2016 and other Provisions of the Indian Penal Code.

A counter affidavit has been filed on behalf of the State Respondent, from which, it appears that the order of suspension has been revoked by subsequent order dated
