The petitioner is apprehending his arrest in connection with Chapra (M) P.S. Case No. 418 of 2018 for the offences under Sections 272 and 273 of the Indian Penal Code and Sections 30, 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. Referring to the prosecution case he submits that liquor was seized from the brick kiln and not from the house or conscious possession of the petitioner. The petitioner was not selling liquor and he has no concern with the sale and business of the liquor. Considering the totality of the facts situation, let the
