JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-08-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the opposite parties including learned senior counsel V.N. Prasad assisted by Soni Srivastava for the economic offences department.
Petitioner is in custody in connection with in Sandesh P.S. Case No. 9 of 2019 for the offence under section 420, 472, 489 (A) (C) (D) (E)/120(B)B of the Indian Penal Code. The allegation against this petitioner is that he was involved in manufacturing of fake currency.
Learned counsel submits that petitioner was apprehended at the place with alleged fake currency of Rs. 2100/-. He further submits that the house belongs to his relative
Patna High Court CR. MISC. No.30767 of 2019(4) dt.17-08-2019 2/2 Nagendra Yadav and Nagendra Yadav has been granted bail by a coordinate bench of this court.
Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara, in connection with Sandesh P.S. Case No. 9 of 2019 subject to the condition that petitioner shall deposit Rs. 50,000/- (Fifty thousand) cash in the court below and the deposit amount shall be abide by final out come in the pending criminal case. In the event, the petitioner acquits, the deposited amount shall be refunded to the petitioner otherwise, it shall be forfeited.
