2. The petitioner apprehends his arrest in connection with Hisua P.S. Case No. 675 of 2025, registered for the offenses punishable under Sections 190, 191(2), 126(2), 115(2), 118(2), 351(2), 351(3), 352 and 109 of the B.N.S.

3. Allegedly while the informant was engaged in ploughing the field along with his son, in the meanwhile, the petitioner along with others variously armed came there and threatened to withdraw the earlier case with a dire consequences. Upon protest, this petitioner has assaulted the informant by means of khanti over his head due to which he sustained serious injuries.

4. Learned Advocate for the petitioner submits that besides there is case and counter-case bearing Hisua P.S. Case No. 674 of 2025, which is on earlier point of time the longstanding land dispute is also evident from the pendency of Title Suit No. 468 of 2022, which has been filed by the informant of the case. It is further contended that the injury which is alleged to have sustained to the informant, the same is found to be simple in nature. To support the aforesaid contention, the injury report has been placed on record. The petitioner is said to be carrying one criminal antecedent, however, he is on bail in the said case.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submits that there is specific accusation against the petitioner of causing assault over the vital part of the body.

Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the factum of case and counter-case, coupled with the simple nature of injury and the genesis of the land dispute, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this

No.34610 of 2026(3) dt.27-07-2026 3/3 order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Hisua P.S. Case No. 675 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
