JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Chhatauni P.S. Case No. 132 of 2018 registered for the offences punishable under Sections 30(a) Bihar Prohibition and Excise Act, 2016.

The petitioner is not named in the first information report but in course of investigation one witness, namely, Mahesh Das, claimed that after recovery of illicit liquor from a pickup van, the petitioner came to his house and accepted that the seized liquor belonged to him.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note that the petitioner does not have any criminal antecedents, this

No.73338 of 2018(2) dt.20-12-2018 2/2 anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, East Champaran at Motihari in Chhatauni P.S.
