In this case, the petitioner is seeking anticipatory bail in connection with Bihta P.S. Case No. 397 of 2017 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act, 2016 and sections 272 and 273 of the Indian Penal Code.

Some persons have been arrested near the railway track along with illegal liquor and they have informed the police that the petitioner is said to have supplied the liquor to sell the same.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the

Patna High Court CR. MISC. No.32119 of 2019(2) dt.15-05-2019 2/2 petitioner surrenders and prays for regular bail, the court below without being prejudiced by the order of this Court, will take decision in accordance with law.
